This Court on 03.10.2024 proceeded to pass the following order: "Vakalatnama, filed on behalf of opposite party No.2 by Sri Rahul Kr. Jadaun, is taken on record. Heard Sri Mohd. Daud, learned counsel for the applicants, Sri Rahul Kr. Jadaun, learned counsel for opposite party No.2 and Sri Rajbahadur Verma, learned A.G.A. for the State. The present application has been filed for quashing the proceeding of Criminal Case No. 2628 of 2020 (State vs. Shakeel Ahmad), arising out of Case Crime No. 260 of 2019, u/s 323, 504, 506, 427, 325 I.P.C., P.S. Shahi, District Bareilly, pending before Judicial Magistrate-III, Bareilly on the basis of compromise entered into between the parties. Learned counsel for the parties submit that the parties have settled their dispute amicably which has also been reduced into a written compromise deed. It is further submitted that the written compromise deed has already been filed before the Judicial Magistrate, Court No.3, Bareilly. Considering the above submission, Judicial Magistrate, Court No.3, Bareilly is directed to verify the compromise after summoning the parties and after verification of the same he will send his report along with a copy of the verified compromise to this Court on or before the next date of listing. List in the week commencing 6.11.2023. Till the next date of listing, no coercive action shall be taken against the applicants in Criminal Case No. 2628 of 2020 (State vs. Shakeel Ahmad), arising out of Case Crime No. 260 of 2019, u/s 323, 504, 506, 427, 325 I.P.C., P.S. Shahi, District Bareilly. " 3. There happens to be a report dated 06.11.2023 of Judicial Magistrate II, Bareilly showing the fact that the parties have compromised and the same stands verified. 4. Learned counsel for the applicants submits that the proceedings be quashed. 5. In view of the above, learned AGA for the State submits that they have no objection to the same. 6. Considering the submission of the parties and stand taken by them, the application stands allowed. 7. The proceedings of Criminal Case No. 2628 of 2020 (State vs. Shakeel Ahmad), arising out of case crime no. 260 of 2019, under Sections 323, 504, 506, 427, 325 IPC Police Station-Shahi District-Bareilly are hereby quashed.
