This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Sessions Trial No. 498 of 2024 in case crime no. 358 of 2023 under Sections 354, 376, 504 I.P.C., Police Station- Siddharth Nagar, District- Siddharth Nagar pending in the Court of learned Sessions Judge, Siddharth Nagar expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is the informant in the aforesaid case. It is further submitted that charges were framed in this matter on 8.4.2024 and since then the matter is pending for evidence and no evidence has been induced by the prosecution so far. The Court concerned is not taking proper interest in disposal of the said case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. It appears from perusal of the record that the matter was pending at the stage of evidence but on 4.1.2025 an application 31-Kha was moved by the informant and the matter is pending for disposal of the same since then. 7. In the circumstances, the Court concerned is directed to make all endeavours to decide the application 31-Kha preferably within a period of two months from the date of production of certified copy of this order before it, thereafter all endeavours shall be made by it for expeditious disposal of the case,keeping in view the heavy work load in the said Court. 8. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 9. With the above observations, the application stands disposed of.
