On the basis of the complaint filed by Smt.Shridevi wife of Shivanand Hipparagi, Banahatti Police have registered a case in Crime No.155/2024 against the petitioners/accused for the offences punishable under Sections 115(2), 118(1), 109, 137(1)(a), 352, 351 and 3(5) of Bharatiya Nyaya Sanhita, 2023. Heard the argument of the learned counsel on both sides and perused the records. 4. It is submitted that the accused are in judicial custody from the date of their arrest i.e. 13.02.2025. The accused are not required for further investigation. It is submitted that the injured has already been discharged from the hospital. Except the offence under Section 307 of the Code of Criminal Procedure, other offences alleged against the petitioners/accused are not punishable with death or imprisonment for life. - 4 - NC: 2025:KHC-D:7160 CRL.P No. 101592 of 2025 5. Considering the nature and gravity of the offences and age of the petitioners, I am of the opinion that it is just and proper to allow the petition with conditions. 6. Accordingly, I proceed to pass the following: ORDER Criminal Petition is allowed. The petitioners/accused shall be released on bail in Crime No.155/2024 of Banahatti Police Station, Bagalkot district pending on the file of the learned Senior Civil Judge and JMFC, Banahatti, subject to the following conditions: i) The petitioners/accused shall execute a self bond for a sum of Rs.1,00,000/- (Rupees one lakh only) each for the likesum to the satisfaction of the trial Court. ii) The petitioners/accused shall make themselves available for interrogation by police officer as and when required. iii) The petitioners/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts - 5 - NC: 2025:KHC-D:7160 CRL.P No. 101592 of 2025 of the case so as to dissuade him from disclosing such fact to the court or to any police officer. iv) The petitioners/accused shall not tamper the prosecution witnesses in any manner.
