The petitioners have preferred the present petition inter alia with the prayer to quash the order dated 11.04.2025 passed by the respondent no. 2/Collector, Kaushambi. 2. By the aforesaid order, the order passed by the respondent no. 4/The Executive Officer, Nagar Panchayat Ajhuwa, Tehsil Sirathu, District Kaushambi was cancelled and he was directed to pass a fresh order strictly in accordance with law. 3. The relevant observations made by respondent no. 2 reads as follows:- "अधधिशशाषषी अधधिकशारषी दशारशा ददिनशानांक 20.09.2024 कको आदिदेश पशाररत करतदे समय उपरकोक्त तथ्यय कशा भषी परषीक्षण नहहीं दकयशा हहै। दकसषी सम्पधत्ति मम अधधिकशारको ककी घकोषणशा व स्तत्व दनधिशार्धारण करनदे कदे समय ससूक्ष्म अदभलदेखषीय परषीक्षण व सशाक्ष्य सनांकधलत करनदे कदे उपरशान्त हषी दनणर्धाय धलयशा जशानशा चशादहए। उपरकोक्त दववदेदकत दवन्दिदओनां कदे आलकोक मम प्रथमदृष्टशा अधधिशशाषषी अधधिकशारषी दशारशा पशाररत आलकोच्य आदिदेश ददिनशाक 20.09.2024 अवहैधिशादनक च अदनयदमत प्रतषीत हकोतशा हहै। नशामशान्तरण आदिदेश सम्यक गदणदिकोष पर आधिशाररत नहहीं हहै। अततः अधधिशशाषषी अधधिकशारषी नगर पनांचशायत अगदवशा दशारशा पशाररत प्रश्नगत आदिदेश ददिनशाक 20.09.2024 सस्थर रहनदे यकोग्य नहहीं हहै तथशा पदनतः पररक्षणषीय हहै। " 4. Heard counsel for the parties and peruse the record. 5. In the facts and circumstances of the case, the present petition is disposed of directing the respondent no. 4/The Executive Officer, Nagar Panchayat Ajhuwa, Tehsil Sirathu, District Kaushambi to pass a fresh order taking into consideration the observations as made in the order dated 11.04.2025 most expeditiously strictly in accordance with law and without granting unnecessary adjournment unless there is no legal impediment. 6. The petitioners are free to raised all their objections before the respondent no. 4.
