ORAL ORDER (PER: THE HON'BLE MR JUSTICE S.VISHWAJITH SHETTY)
1. Accused Nos.1, 2 and 3 in S.C.No.5059 of 2025, pending before the Court of VII Additional District and Sessions Judge, Belagavi sitting at Chikkodi, arising out of Crime No.9 of 2025, registered by Yamakanmardi Police Station, Belagavi district for offences punishable under Sections 302, 201, 120B read with Section 3(5) of BNS 2023, are before this Court in these three petitions filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS 2023) seeking regular bail. 2. Heard learned counsel for the parties. 3.
FIR in Crime No.9 of 2025 was registered by Yamakanmardi Police Station, Belagavi initially for offences punishable under Sections 120B, 302, 201 read with Section 3(5) of BNS 2023 against Nagappa Siddappa Malagi and 4 others based on the first information dated 13.01.2025 received from Appayya Vitthal Mareppagol, who is the elder brother of deceased Nagappa Vitthal

Mareppagol. During the course of investigation, accused Nos.1 and 2 were arrested on 13.01.2025 and accused No.3 was arrested on 22.01.2025. After completing investigation, charge sheet has been filed against 5 persons, out of which, accused No.5 is said to be a juvenile accused. Petitioners herein are arrayed as accused Nos.1 to 3 in the charge sheet. Their bail application filed before the Jurisdictional Sessions Court was rejected. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that accused No.2 is the widow of deceased Nagappa Vitthal Mareppagol, who allegedly had died on 08.06.2022. After the dead body of deceased was recovered in the present case, a UDR case was registered and subsequently the dead body was handed over to the relatives of the deceased and was cremated. On 13.01.2025, first informant, who is the brother of the deceased, had approached the police and submitted first information alleging that he had reasonable grounds to suspect that

his brother Nagappa Vitthal Mareppagol was murdered by the accused named in the FIR. It is under these circumstances FIR was registered against the 5 named persons and during the course of investigation, petitioners herein who are arrayed as accused Nos.1 to 3 in the FIR were arrested. After completing investigation, charge sheet has been filed. 5. As per the charge sheet allegations, accused Nos.1 and 2 had illicit relationship and therefore they had decided to eliminate deceased Nagappa Vitthal Mareppagol, husband of accused No.2. In furtherance of their conspiracy to eliminate Nagappa Vitthal Mareppagol, they had contacted accused Nos.3 and 5 and had given supari to them to commit the murder of Nagappa.
On 08.06.2022, accused Nos.3 to 5 allegedly took Nagappa Vitthal Mareppagol along with them in a motorcycle on the pretext of consuming alcohol and thereafter committed his murder by strangulating his neck with the help of a rope. Entire case of the prosecution is based on circumstantial

evidence. First information is submitted after a lapse of more than 2 ½ years from the date of death of the deceased Nagappa Vitthal Mareppagol, and the dead body of the deceased was cremated in the year 2022 itself. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered in the affirmative. Accordingly, the following:
ORDER i. Petitions are allowed. ii. The petitioners/accused Nos.1 to 3 are
directed to be enlarged on bail in S.C.No.5059 of 2025, pending before the Court of VII Additional District and Sessions Judge, Belagavi sitting at Chikkodi, arising out of Crime No.9 of 2025, registered by Yamakanmardi Police Station, Belagavi district for offences punishable under Sections 302, 201, 120B read with Section

3(5) of BNS 2023, subject to the following conditions:
1. The petitioners/accused Nos.1 to 3 shall execute personal bond for a sum of Rs.1,00,000/- with 2 sureties each for the likesum to the satisfaction of the jurisdictional Court;
2. The petitioners/accused Nos.1 to 3 shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons;
3. The petitioners/accused Nos.1 to 3 shall not directly or indirectly threaten or tamper with the prosecution witnesses;

4. The petitioners/accused Nos.1 to 3 shall not involve in similar offences in future;
5. The petitioners/accused Nos.1 to 3 shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
