1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.150/2024 registered at Police Station – Devendra Nagar District-Raipur (C.G.) for the offences punishable under Sections 7 of Chhattisgarh Gambling (Prohibition) Act, 2022. Prosecution story in brief is that on 07.04.2024, Police received information from an informer that a person was betting on the win or loss of money in an online cricket match through mobile in the parking lot near Samaleshwari Nagar. On the said information, they reached the spot with the staff members, cordoned off the area and caught co-accused Kamal Khatwani and seized a Samsung mobile from his possession. Accused Kamal Khatwani was arrested on the charge of betting on the win or loss of money in online cricket through a classic website using his mobile phone. Upon his memorandum the present applicant has been made as an accused.

Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. It has been argued by learned counsel for the applicant that only on the basis of the memorandum statement of the co- accused namely Kamal Khatwani, he has implicated in crime in question and Co-accused namely Kamal Khatwani has already been granted regular bail by the learned Special Judge (Atrocities) Raipur (C.G.) and investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.

Learned counsel for the State has pointed out that the bail rejection order passed by the learned trial court on 25.08.2025, wherein case crime number mentioned as 105 of 2024 in place of 150 of 2024, and it has correctly been mentioned in the last portion in the said order i.e.150 of 2024 and submits that the
3 applicant has been absconding since the date of registration of the offence, and investigation against him is ongoing, therefore, the applicant is not entitled for grant of anticipatory bail in the present case.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties and further the fact that the trial of the instant case is going on and the co-accused person has already been granted bail by the trial Court and the applicant is stated to be absconding during the trial, thus, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant– Rahul Narwani @ Pankaj filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.150/2024 registered at Police Station – Devendra Nagar District-Raipur (C.G.) for the offences punishable under Sections 7 of Chhattisgarh Gambling (Prohibition) Act, 2022, is rejected.
