THE ASSISTANT EXECUTIVE ENGINEER, (RIMS AND S) SUBDIVISION, ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declare the action of the respondents in withholding the bill net payment of Rs.31,25,726/- payable to the petitioner in relation to the execution of three works namely even after finalizing the bills payable to the petitioner in relation to the execution of the works under contract vide i) Agreement No. /AEE2/Kalludevaranahalli/ 2016- 17, dated 15-04-2017, (ii) Agreement No. /AEE2/Pulakumta/2016-17, dated 15-04-2017 (iii) Agreement No. /AEE2/Gummagatta/ 2016-17, dated 25-09-2017, even after the same was recorded by the concerned authorities in the measurement, books and- even issuing Quality control certificates and after thorough inspection and verification, and not considering the same is . arbitrary, illegal, and in violation of well settled principles of natural justice, and consequently direct the respondents to pay an amount of a) Rs 7,21,258/- b) Rs 10,74,386/- c) Rs 13,30,082/- due under contract vide i) Agreement No. /AEE2/Kalludevaranahalli/ 2016-17, dated 15-042017, (ii) Agreement No. /AEE2/Pulakumta/2016-17, dated 15-042017 (iii) Agreement No. /AEE2/Gummagatta/ 2016-17, dated 25-09-2017in respect of execution of afore mentioned works forthwith and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the respondents to take steps to pay the amount a) Rs 7,21,258/- b) Rs 10,74,386/- c) Rs 13,30,082/- due under contract vide (i) Agreement No. /AEE2/Kalludevaranahalli/ 2016-17, dated 15-04-2017, (ii) Agreement No. /AEE2/Pulakumta/2016-17, dated 15-04-2017 (iii) Agreement No. /AEE2/Gummagatta/ 2016-17, dated 25-09-2017,pending disposal of this Writ Petition and pass such Counsel for the Petitioner: 1.
