This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 352/2015, registered at Police Station-Janjgir, District Janjgir Champa, (CG), for the offence punishable under Section 420/34 ANKIT KUMAR SINGH Digitally signed by ANKIT KUMAR SINGH Date: 2025.10.13 18:22:15 +0530 2 of the IPC and Section 3, 4 & 5 of the Chit Fund Act and Prize Chits and Money Circulation Schemes (Banning) Act and Sections 6 & 10 of the Chhattisgarh Protection of Depositors Interest Act, 2005. 2. Case of the prosecution, in brief, is that the applicant being Director/Agent of Pratishta Infracon India Limited Company invited investment assuring doubling of invested amount and the same was not returned to the complainant and thereby committed the aforesaid offence. 3. Mr. Abhishek Sinha, learned Senior Counsel for the applicant would submit that co-accused namely Ramgopal, Narayan Prasad Jhalariya, Manharan Lal Kenwat, Amit Sarkar, Subhayan Banerjee and Sanjeev Guha in MCRC Nos.4584/2019; 7717/2022; 9837/2022; 2374/2023; 2915/2023 and 4473/2023, respectively, being Director and Agent have already enlarged on bail. He would also submit that the case of the present applicant is similar to the case of the other co-accused persons who have already enlarged on 3 bail. He would further submit that the applicant is in jail since 12.09.2025 and no custodial interrogation is required, therefore, the bail application of the present applicant is liable to be allowed. 4. On the other hand, learned counsel for the State would oppose the bail application. He would also submit that the applicant absconding for a fairly long time, therefore, the regular bail may not be granted to the present applicant. 5. I have heard learned counsel appearing for the parties. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that other co-accused persons being a Director and Agent have been already granted bail and their order has become final and the present applicant is being a share holder in jail for more than a month, whose case is similar to the co-accused persons, further considering that the conclusion of the trial will take some more time, this Court is of the view that the present applicant is entitled to 4 be released on bail in this case. 7. Let the applicant – Bhairav Mishra @ Mongli, involved in Crime No. 352/2015 registered at Police Station - Jangir, District – Janjgir Champa(C.G.), be released on bail on his furnishing a personal bond in the sum of ₹25,000/ with one surety in the like sum to the satisfaction of the concerned Court for his appearance as and when directed. 8.
