GP FOR REVENUE The Court made the following: 3 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a Writ, or order or direction, more so a Writ in the nature of MANDAMUS to declare inaction of Respondents more particularly Respondents 4 and 5 in conducting Survey and demarcating the boundary of the Petitioners land an extent of Acres 0.15 cents in Sy.No.367 situated in Alamur Village of Rudravaram Mandal, Nandyal District as illegal, arbitrary, dereliction of statutory duties and contrary to the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923 and violative of fundamental rights guaranteed under Articles 14 and 21 of the Constitution of India and consequently to direct Respondent No.4 and 5 to conduct survey and demarcate the boundary of the Petitioners land an extent of Acres 0.15 cents in Sy.No.367 situated in Alamur Village of Rudravaram Mandal, Nandyal District and pass such other orders…” 2. Shorn of all unnecessary facts in the affidavit filed in support of the Writ Petition, it is the specific case of the petitioner that she submitted an application bearing No.NND202507214332 dated 21.07.2025 for conducting of survey and demarcating the boundary of the petitioner’s land and the respondent authorities went on postponing the survey. The said inaction on the part of the respondents in processing the application of the petitioner, the petitioner was constrained to approach this Court. 3. Learned Assistant Government Pleader for Revenue would submit that appropriate action will be taken on the application submitted by the petitioner in accordance with law. 4. Considering the submissions of learned counsel for both sides, without going into the merits of the case, this Court is inclined to direct 4 the respondent – authorities to consider the application bearing No.NND202507214332 dated 21.07.2025 for conducting of survey and demarcating the boundary of the petitioner’s land, by issuing notice to all the concerned / interested persons and pass appropriate orders in accordance with law within a period of two (2) months from the date of receipt of a copy of this order. 5. Learned counsel for the petitioner raises concerns about safety and the possibility of brawl in completing the survey due to obstructions by the villagers (neighbouring) are actively preventing the survey process. Hence, it is urged that this Court may direct the police to provide protection enabling to facilitate smooth conduct of survey which is being conducted under the Survey and Boundaries Act. 6. Considering the submission of the learned counsel for the petitioner, the petitioner shall submit an application before the concerned police seeking protection on the dates on which they will conduct survey. If such an application is submitted by the petitioner, the police shall do the needful in accordance with law. 7. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
