The petitioner, before this Court, was married with respondent on 16.02.2022 according to Hindu Rites and Customs. Matrimonial dispute arose between the parties which led to parties living separately. A petition for mutual divorce was filed by respondent which was registered as Matrimonial Case No. 396 of 2024 before Principal Judge, Family Court, Ghazipur on 28.05.2024. It was alleged that in Criminal Misc. Writ Petition No. 802 of 2024, the matter was referred to Mediation and Conciliation Centre of Allahabad High Court on 31.01.2024 wherein a settlement was arrived between the parties in the meeting held on 03.03.2024, 31.03.2024, 21.04.2024, 05.05.2024 and 26.05.2024 for seeking mutual divorce. 2. The present petition has been filed seeking a direction upon court below to decide the Matrimonial Case No. 396 of 2024 expeditiously. From perusal of the order-sheet appended along with the writ petition, it transpires that matter has been fixed on number of occasions after the presentation of the case but till date no orders have been passed by court below. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondent, with a direction upon Principal Judge, Family Court, Ghazipur to decide the Matrimonial Case No. 396 of 2024, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
