By means of present C528 application, applicants have challenged cognizance/summoning order dated 26.11.2022 as well as the entire proceedings of Misc. Case No.114 of 2020, Ajeeta vs. Anit & others, under Sections 498-A, 323 & 504 IPC and Section 3/4 of the Dowry Prohibition Act, pending in the court of learned Judicial Magistrate-1st, Haridwar. 2. After arguing for a while, learned counsel for the applicants has limited his prayer to the extent that applicants may be permitted to surrender before the court concerned within fifteen days, with a further prayer that their bail applications may be directed to be decided expeditiously in the light of judgment passed by the Hon’ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and Another, 1 2025:UHC:2793 reported in (2021) 10 SCC 773. For the sake of convenience, relevant portion thereof is quoted hereinbelow:- 3.Category A(e) Bail applications of such accused on appearance may be decided without the accused being taken in physical custody or by granting interim bail till the bail application is decided. 3. In such view of the matter, present C528 application is disposed of permitting the applicants to surrender before the concerned court on or before 01.05.2025; if on surrender, any bail application is moved on their behalf, the court concerned is directed to decide the same in view of dictum of the Apex Court in the case of Satender Kumar Antil (Supra). 4.
