IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.12375 of 2025
Monalisha Naik @ Dehury @ Monalisha Nayak … Petitioner
Mr. J. Khansama, Advocate -versus- State of Orissa … Opposite Party Mr. P. Satpathy, Addl. PP
CORAM:
JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 18.02.2026
03.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Rairakhol PS Case No.104 of 2025 corresponding to GR Case No.259 of 2025 pending in the file of learned Addl. District & Sessions Judge, Rairakhol for commission of offences punishable U/Ss.103(1)/238 of BNS, on the main allegation of committing murder of her mother-in-law by strangulating her.
3. Heard Mr. Julu Khansama, learned counsel for the petitioner and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record including the copy of depositions of PWs.1-9.
4. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioner vis-à-vis the allegation sought to be brought against him and
regard being had to the materials placed on record, keeping in view the evidence of the witnesses so far examined in this case and trial having progressed substantially within one year of the custody of the petitioner and taking into account the other circumstances on record in entirety, this Court is not inclined to grant bail to the petitioner at this stage.
5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands
disposed of. A soft copy of the order be immediately communicated to the learned trial Court.
In view of the alternative oral prayer as advanced for the petitioners, trial be expedited, if there is no other legal impediment. A soft copy of the order be immediately sent to the learned trial Court.
