1. Petitioner has filed this writ petition seeking following reliefs. 10.1 That, this Hon'ble Court may kindly be pleased issue order, or direction, directing the respondents to allot equivalent land to the petitioner in exchange for the land bearing Khasra Nos. 118/3 and 124/294/2, which has been utilized for public purposes. 10.2 That, this Hon'ble Court may kindly be direct the respondent authority to comply with the order dated 22-02-2021. 10.3 That, in alternative this Hon'ble court may kindly direct the respondents to pay due and fair compensation to the petitioner in accordance with law for the land PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA Date: 2025.11.04 16:55:42 +0530
2 / 3 acquired/used for public purpose in failure of compliance of order 22-02-2021. 10.4 That, this Hon'ble Court may kindly be Direct the respondents to pay compensation for mental harassment, financial hardship, and emotional distress caused to the petitioner due to prolonged delay and inaction. 10.5 That, this Hon'ble Court may kindly be Direct the respondents to complete the proceedings relating to allotment or compensation within a fixed time frame as deemed just by this Hon'ble Court. 10.6 Any other order/relief which this Hon'ble Court may deem fit, proper and just in the
facts and circumstances of the present case may also kindly be awarded to the Petitioner in the ends of justice & equity.”

Learned counsel for petitioner submits that Respondent No. 2/ Commissioner vide order Annexure P-1 dated 22.02.2021 set aside the order passed by Respondent No. 1/ Collector and further directing the Collector to provide any other land in exchange of the land of petitioner which is being used for the purpose of construction of stadium (play ground). However, till date the Respondent No.1/ Collector has not taken any steps for allotment of any other government land to petitioner. Therefore, petitioner has submitted a representation before Respondent No. 1/ Collector vide Annexure P-2 in the year 2022, which is still pending consideration and no order has been passed. Therefore, direction be issued to Respondent No. 1/ Collector to pass appropriate orders of allotment of land in exchange of land of petitioner used for construction of stadium ie., part of khasra No. 124/294/2 measuring 0.292 acres.
3. Learned State counsel submits that according to her instructions Respondent No. 1/ Collector has already initiated proceedings for compliance of order passed by Respondent No. 2/ Commissioner. She further submits that she is not having any objection to the limited prayer made by learned counsel for petitioner of issuance of direction to Respondent No. 1/ Collector to consider
3 / 3 and pass appropriate orders on the representation submitted by petitioner.
4. I have heard learned cousnel for the parites.

Considering the submission made by learned counsel for the respective parties, nature of grievance raised, I find it appropriate to dispose of this writ petition at this stage, directing Respondent No. 1/ Collector to pass appropriate orders on the representation submitted by petitioner on 20.04.2022, Annexure P-2, pursuant to the order passed by Respondent No. 2/ Commissioner dated 22.02.2021, in accordance with law expeditiously preferably within a further period of 08 weeks from the date of receipt of copy of this order.
6. With the aforesaid observation and direction, this writ petition stands
