Neutral Citation No. - 2025:AHC:65461 Court No. - 38 Case :- WRIT - A No. - 24079 of 2018 Petitioner :- Daya Nand Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Brijesh Pratap Mishra,Sriram Dhar Dubey,Sudhir Kumar Singh,Vibhuti,Vishwa Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Donadi Ramesh,J. The grievance of the petitioner is that initially the claim of the petitioner is rejected by respondent vide order dated 06.02.2008. The petitioner has approached this Court in Writ A No. 25799 of 2008. The said writ petition is allowed vide order dated 11.01.2013, with the following directions:- "The matter is remitted to the District Inspector of Schools to decide the matter as expeditiously as possible but later than three months from the date of communication of this order keeping in view that the petitioner is stated to be worked continuously for the last several years and on account of inaction on the part of the Education Authorities, the matter is still pending even after a direction of this Court. The District Inspector of Schools has taken three years time to decide the representation of the petitioner and no affidavit has been filed by him controverting the averment of the writ petition though the writ petition is pending for the last five years. The District Inspector of Schools, for the said reason may take expeditious decision within the time framed by this Court. The writ petition is allowed. No order as to costs." Pursuant to the above said directions, the second- respondent has forwarded the proposals on 25.07.2017 to the third-respondent. The said proposals are still pending for consideration. On perusal of the orders passed by this Court, there is a specific direction to the respondents to pass orders expeditiously not later then three months from the date of communication of the order and even after lapse of decade the respondents have yet not passed any order in this matter. When the matter is taken up for hearing today, it was brought to the notice of the learned Standing Counsel that the respondents have not passed any order and still proposals are pending with the second-respondent for consideration. Considering the said submissions, restraining to initiate suo moto contempt against the respondent for non-implementation of the specific directions issued by this Court in Writ A No.25799 of 2008, one more chance is given to the respondents, with specific directions to the third-respondent to consider the relevant material and proposals sent by the second-respondent dated 25.07.2017 and pass appropriate orders within a period of two weeks from the date of receipt of the order and communicate the same to the petitioner. Accordingly, the present writ petition is disposed of. Order Date :- 28.4.2025 AdityaG (Donadi Ramesh,J.) Digitally signed by :- ADITYA GAUTAM High Court of Judicature at Allahabad
