The present bail application has been listed for final hearing in the weekly cause list published for the week commencing 13th October, 2025. On 13.10.2025 when the matter was called on for hearing, no one appears on behalf of the applicant and the matter was passed over. Again on 14.10.2025 no one appears to pursue the bail application. Today also when the matter is being called on for hearing, no one appears on behalf of the applicant. 2. Since the applicant is in jail and claiming bail in the offence, this court deem it appropriate to decide the bail application on the basis of material available in the case diary. 3. This is first bail application seeking grant of bail to the Applicant who is in jail since 11.12.2021 in connection with Crime No.401/2021 Digitally signed by INDRAJEET SAHU Date: 2025.10.16 11:42:59 +0530 2 registered at Police Station City Kotwali, Bilaspur, for the offence punishable under Section 302 IPC. 4. Perused the case diary available with the State counsel. 5. The case of prosecution is that, in the intervening night of 8-9 December, 2021, the applicant committed murder of his wife by causing injuries on her head while pushing her into wall. On 09.12.2021 the wife of applicant died. Merg was intimated to the police and after investigation the applicant was arrested on 11.12.2021 and charge sheet was filed. 6. From perusal of case diary it transpires from the statement of Jamni Bai, Laxmi Dhruw, Ishwari, Aman Rao Wankhede and Rajni Bai Wankhede that there were frequent quarrel between the applicant and deceased and on fateful night they were together in the room at the relevant point of time and in the morning the deceased found dead in unnatural condition in her room. It further transpires that in the postmortem report, the cause of death is reflected due to head injury and its complications. From the order sheet of trial court dated 09.06.2025 it further transpires that out of 17 witnesses, 13 witnesses have already been examined and trial is at advanced stage. 7. Thus, in view of all the aforesaid facts and circumstances of the case, this Court is of the opinion that present is not a fit case where the Applicant can be enlarged on bail. 8.
