Shri Hausihla Prasad Mishra, learned counsel for the petitioner submits that the suspension order has been withdrawn. The cause on which the writ petition is founded does not survive. The writ petition has become infructuous. However, Shri Hausihla Prasad Mishra, learned counsel for the petitioner recasts his prayer. He submits that the salary of the petitioner for the period of suspension may be released forthwith. Shri Gambhir Tripathi, learned counsel for the respondents No.2 and 3 does not have any serious objection to the aforesaid prayer. The respondent No.3-Executive Officer, Nagar Palika Parishad, Pilakhuwa, District-Hapur is directed to forthwith release the salary of the petitioner for the period of suspension as per law.
