2. This is an application, filed under Section 5 of the Limitation Act, 1963, praying for condonation of delay of 35 days in filing the connected appeal.
3. The ground for delay in preferring the connected appeal has been explained in paragraph Nos. 2, 3 & 4 of the condonation petition.
4. Having considered the grounds stated in the said paragraphs, this Court is satisfied that the applicant was prevented by a sufficient cause from preferring the connected appeal within a stipulated time.
5. Moreover, Mr. Paul, learned counsel appearing on behalf of the respondent/insurance company No.1 has no objection in condoning the delay.
6. In view of the above, the delay of 35 days in preferring the connected appeal is hereby condoned.
7. With the above, the I.A. stands disposed of.
8. The Registry is directed to register a case and thereafter, refer the same before the Lok Adalat for settlement, as the parties are willing to explore the possibilities of settlement of the matter before Lok Adalat.
9. The Registry is also directed to reflect the name of Mr. R.C. Paul as the counsel for the respondent/insurance company No.1 in the cause-list.
