[2025:RJ-JP:4351] (1 of 3) [CRLMB-1472/2025] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1472/2025 Vikas Jat @ Vikki S/o Shri Ganesh Chand Chaudhary, Aged About 19 Years, R/o Village Kothun, Police Station Chaksu, District Jaipur, Rajasthan, (Presently Confined In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Anshuman Saxena For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 31/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 593/2023 registered at Police Station Chaksu, District Jaipur (South) for offences under Section 379 of IPC. It is contended by counsel for the petitioner that the petitioner has falsely been implicated in this case solely on the disclosure statement of other co-accused. Recovery of stolen bovine animal was effected from the other co-accused Nizam. Counsel further contended that petitioner is in custody since 23.12.2024 and investigation/trial of the case will take time. Offences alleged to have been committed by the petitioner are triable by Magistrate, therefore, the petitioner may be enlarged on bail. [2025:RJ-JP:4351] (2 of 3) [CRLMB-1472/2025] Per contra, learned Public Prosecutor opposes the grant of bail application and contended that the petitioner is a habitual offender and against him six similar nature of cases have been registered at various police stations in Rajasthan, therefore considering the criminal record of the petitioner, his bail application deserves to be dismissed. Heard and perused the material available on the record. Considering the arguments advanced by counsel for the parties and looking to the fact that petitioner is in custody since 23.12.2024 and trial of the case will take considerable time, furthermore case of the petitioner is triable by Magistrate, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Vikas Jat @ Vikki S/o Shri Ganesh Chand Chaudhary, in connection with FIR No. 593/2023 registered at Police Station Chaksu, District Jaipur (South) for offences under Section 379 of IPC. shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the date of hearing and as and when called upon to do so. The accused- petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the [2025:RJ-JP:4351] (3 of 3) [CRLMB-1472/2025] learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
