The instant application has been filed on behalf of the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) r/w Section 528 of the BNSS, seeking grant of regular bail in relation to FIR No.733/2022 registered at PS Sultanpuri qua the offence punishable under Sections 29/22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (‘NDPS Act’).

Learned counsel appearing on behalf of the applicant submits that the applicant is innocent and has been falsely implicated in the instant case. He also submits that the applicant, his wife and daughter all are suffering from Human Immunodeficiency Virus (HIV), the applicant has no criminal antecedents. would not establish the complicity of the applicant. He further submits that there is a violation of the statutory provisions of Sections 50 and 52A of the NDPS Act. In any case, according to him, bearing in mind the long incarceration and the fact that the trial will take some period of time, the rigours of Section 37 of the NDPS Act does not get attracted. It is also submitted that another accused namely, Sukhwinder Kaur @ Satvinder Kaur @Amit @ Kutewali has already been granted bail vide order dated 01.09.2025 in Bail Appl. 1607/2025. 3. The submissions made on behalf of the applicant are strongly opposed by learned APP for the State. She contends that bearing in mind the recovery from the applicant and the material available against him; he is not entitled for grant of regular bail. She also submits that there is no violation of any of the provisions of the NDPS Act. 4. I have considered the submissions made by learned counsel for the parties and perused the record. 5. The facts of the case would indicate that on 22.08.2022, during routine patrolling duty, the concerned police official saw a man carrying a white bag, who turned back after seeing the said official and upon being chased, was found to be in possession of 15 Buprenorphine injections (2 ml each), 15 Avil injections (10 ml each), 30 needles and 15 Syringes. The notice under Section 50 of the NDPS Act was stated to have been served and it is alleged that the applicant refused to be searched before the Gazetted Officer. The applicant was arrested on 23.08.2022. On the disclosure of the applicant, another accused namely, Sukhwinder Kaur @ Satvinder Kaur This is a digitally signed order.

@Amit @ Kutewali was also arrested. The applicant stated that he received the alleged articles in question from Sukhwinder Kaur @ Satvinder Kaur @Amit @ Kutewali. After investigation, the charge sheet has been filed and the matter is pending for trial. 6. Having considered the overall facts and circumstances and without expressing any opinion on the merits of the case, the Court finds that the applicant is entitled for his release on bail. Most of the allegations against the applicant and the other accused who has been granted bail are similar. He is in judicial custody for about 26 months; there is no other criminal case against him; out of total 22 witnesses only 6 witnesses have been examined. Let he be released on bail on such conditions as may be imposed by the Special Court. 7. In view of the aforesaid, the instant application along with the accompanying applications stands disposed of.
