Hon'ble Ajit Kumar,J. 1. Heard Sri Prabhakar Awasthi, learned counsel for the petitioner, learned Standing Counsel for the State-respondents and perused the records. 2. The petitioner by means of the present petition filed under Article 226 of the Constitution of India has prayed for quashing of the order dated 11.12.2024. 3. It is argued on behalf of the petitioner that after the suspension order was passed, the petitioner was issued a charge-sheet to which the petitioner submitted a detailed reply and an oral departmental inquiry was conducted. It is further submitted that after the departmental inquiry, no action has been taken by the Disciplinary Authority in the matter. 4. Learned counsel for the petitioner submits that as per the information, no charges in the oral departmental inquiry have been found to be proved. 5. In the given facts and circumstances, since the petitioner has already participated in the inquiry and the Disciplinary Authority is in receipt of the inquiry report, I find there to be no point for the Disciplinary Authority not to take any final decision in the matter. 6. In such view of the matter, I dispose of this petition with a direction to the Disciplinary Authority to take a final decision in the matter within a maximum period of four weeks from the date of presentation of a certified copy of this order. However, the decision shall be taken by the Disciplinary Authority in full compliance of the principles of natural justice. 7. It is further provided that in the event the Disciplinary Authority fails to conclude the disciplinary proceedings within the period prescribed hereinabove, the suspension order dated 11.12.2024 shall stand revoked with all consequential benefits.
