This contempt petition has been preferred by the applicant under Article 215 of the Constitution of India read with Section 12 of the Contempt of Courts Act, 1971 for non-compliance of order dated 10/06/2024 passed in WPS No. 2747/2024. Counsel for the applicant submits that order of this Court passed in WPS No. 2747/2024 vide order dated 10/06/2024 has not been complied with. 3. Per contra, learned counsel for the respondent contended that the order of this Court has been complied with. 4. I have perused the order passed by this Court, “In view of the above stated judgment passed by this Court in case of Kailash Sharma (supra), ………….. within further 45 days.” 5. In WPS No. 2747/2024 this Court has observed that husband of the petitioner late Mulchand Mahilange was working as Cook in Tribal Department died on 03/09/2018, this fact has not been disputed by the respondent, however, the order passed by the Assistant Commissioner, Tribal Development Balodabazar-Bhatapara (C.G.) on 22/08/2024, the name of the petitioner is not mentioned in the service record, hence, department wants to produce succession certificate. 6. Therefore, this Court is of the considered view that order of this Court has not been fully complied with later and spirit of the order. The applicant is directed to file a fresh representation and the respondent- authority concerned shall consider and decide the same within a period of three months from the date of receipt of such representation. 7.
