Though notice was served, no one is appearing on behalf of respondent No.5. 2. The petitioner who is a member of Ward No.12, Daondi, District Balod, preferred the present writ petition seeking the limited relief that he has submitted a representation/complaint to the Collector on 21/12/2023 (Annexure P/4) contending that the respondent No.5 who is the president of Daondi Nagar Panchayat whose name is not existing in the voter list of the area of Daondi Nagar Panchayat however, he is continuing as the President of the said Nagar Panchayat. 3. Learned counsel for respondent No.6/Chief Municipal Officer by submitting his reply states that in the present voter list, the name of respondent No.5 is still there in the area of Nagar Panchayat, Daondi and hence the complaint filed by the petitioner is not correct. 4. Learned counsel appearing for the State submits that though no reply has been filed on behalf of the State but if the complaint filed 3 / 3 by the petitioner before the Collector is still pending, the same will be decided within the stipulated period. 5. I have heard learned counsel for the parties and perused the documents. 6. From perusal of the pleadings, it appears that on 21/12/2023 the petitioner has submitted a representation to the Collector/District Election Officer stating some irregularities as far as the name of the President of Nagar Panchayat Daondi in the voter list. 7. As in the present writ petition disputed facts are raised by the petitioner, the Collector is directed to consider and decide the complaint filed by the petitioner by affording opportunity of hearing to the parties including the respondents No.5 & 6 and pass a detailed order within a period of 50 days from the date of receipt of a copy of this order. 8.
