The petitioner has been made accused in connection with S.T. Case No.46(A) of 2008(S) arising out of Simdega P.S. Case No. 65 of 2005, corresponding to G.R. Case No.233 of 2005, for the offences registered under Sections 147, 148, 149, 341, 323, 324, 353, 333 and 307 of the I.P.C., pending in the Court of learned Additional Sessions Judge-I, Simdega. On 09.08.2005 at about 7:00 P.M., the informant along with other police officers went to village Khijri Nawatoli to conduct raid in connection with Simdega P.S. Case No.64 of 2005, when they reached at village- Khijri Nawatoli about 8:00 P.M., 25 to 30 persons variously armed on seeing the police party, attacked them. It was submitted that 19 persons including the petitioner are named in the F.I.R. It was further submitted that there was general and omnibus allegation against all the accused persons. It was further submitted that 15 persons have faced trial and they have been acquitted. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Simdega, in connection with S.T. Case No.46(A) of 2008(S) arising out of Simdega P.S. Case No. 65 of 2005, corresponding to G.R. Case No.233 of 2005. (Ambuj Nath, J.) Jay/-
