HC-KAR NC: 2025:KHC-D:10666-DB WP No. 106142 of 2025
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM:
THE HON'BLE MR. JUSTICE S.SUNIL DUTT YADAV AND THE HON'BLE MR. JUSTICE C.M. POONACHA
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S.SUNIL DUTT YADAV)
The present petition has been filed challenging the order of the Tribunal dated 19.8.2025, whereby the Tribunal has issued notice and deferred consideration of interim relief till 15.9.2025 while directing to file reply statement.
2.
Learned counsel for the petitioner has raised various contentions relating to the entitlement for interim relief. However, noticing that the interim relief is still kept open for
consideration, we find no reason to interfere in such order. While noticing that the request for consideration of exparte interim prayer is solely within the discretion of the Tribunal, which discretion having been exercised, no grounds are made out to interfere with the order of Tribunal.
3. It is also necessary to notice that if any observation is made in this petition, it would prejudice the petitioner. Hence, we refrain from entertaining the petition. Accordingly,

the petition stands dismissed. Needless to state that it is open for the petitioner to make request before the Tribunal for
consideration of interim prayer on the next date of hearing. Pending applications, if any, are disposed off as not surviving for consideration.
