GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 11930/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ, order or direction, more particularly a Writ in the nature of Mandamus, declaring the action of the respondents especially Respondent No.4 in calling the petitioner herein to the police station and in interfering with the civil disputes pending between the petitioner and the Respondent Nos.5 to 8 and forcing the petitioner to withdraw the suit filed by the petitioner vide O.S. No. 283 of 2023 and further forcing the petitioner to handover the possession of the land to an extent of Ac. 0.6 1/2 cents situated in Sy.No. 679/3 within the limits of Erraballe village fields, Pulivendula mandal, Kadapa District and to act as per the terms and conditions of the Respondents No.5 to 8 is perse illegal, arbitrary, unfair apart from violative of Principles of Natural Justice and violative of Articles 14, 19 and 21 of the Constitution of India consequently direct the Respondent No. 4 herein not to call the petitioner to the police station without there being any crime registered against the petitioner and not to interfere in Civil Disputes pending between petitioner and the unofficial respondents.…” 2. Heard Sri V.Nitesh, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned counsel for the petitioner would submit that the respondent police are calling the petitioner to the police station and coercing to settle the civil disputes, thereby interfering in the civil disputes between the petitioner and the unofficial respondents. 4 4. Learned Assistant Government Pleader for Home, on instructions, would submit that the respondent-police are not interfering in the civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes except under due process of law. No order as to costs.
