SHAIK AKBAR BASHA, PRAKASAM AND GANDHI VEEDHI, (KAIKALA STREET), SRIKALAHASTHI TOWN, POST AND MANDAL, TIRUPATI DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate Writ more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent herein in passing the impugned order vide R.Dis.A/165/2024 dated 23-01- 2025 where under the 4th respondent by entering into shoes of the Hon'ble Civil Court had decided the title of the property which is without Jurisdiction, inspite of revision petition filed by this petitioner pending before the 2nd respondent vide Revision Petition No. 217/2024 as against the orders passed by the 3rd respondent herein in appeal vide D.Dis.(D2)/150/2024 dated 09- 10-2024 by observing that no revision is filed and further act of the 4th respondent in mutating the revenue records pertaining to land admeasuring an extent of Ac 0.90 cents in S.No 149/1 situated at Srikalahasthi Village and Mandal Tirupati District, by deleting the name of this petitioner without even waiting for the appeal time of 60 days as mentioned in the impugned order as illegal, arbitrary, without Jurisdiction, opposed to the established principles of law and in violation of Fundamental Rights guaranteed to this petitioner under Article 14 of the Constitution of India apart from infringement of Right to Property as guaranteed under Article 300A of the Constitution of India and consequently set aside the Impugned Order and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to suspend the Impugned Order passed by the 4th respondent vide R.Dis.A/165/2024 dated 23-01-2025 by restoring the name of this Petitioner in the revenue records pertaining to land admeasuring an extent of Ac 0.90 cents in S.No 149/1 situated at Srikalahasthi Village and Mandal Tirupati District pending disposal of the present Writ Petition and pass 3 HDR,J W.P.No.3292 of 2025 IA NO: 2 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to vacate the Order Dt. 17.02.2025 in I.A.No.l of 2025 in W.P.No.3292 of 2025 and dismiss the above Original Writ Petition with exemplary costs, in the interest of justice and pass IA NO: 3 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to vacate the interim order dated 07.02.2025 in WP.No.3292 of 2025 and dismiss the writ petition and pass Counsel for the Petitioner: 1.
