This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue an appropriate writ order direction more particularly one in nature of Writ of Mandamus declaring the inaction of the 3rd and 4th Respondents in not registering an FIR on the Petitioners written complaint dated 24.07.2025 as being illegal, arbitrary and unconstitutional and violative of Articles 14 21 and 300A of the Constitution of India and Consequently direct the 4th Respondent to forthwith register an FIR against Respondents No.5 and 6 based on the Petitioner’s complaint dated 24.07.2025 and cause a fair and impartial investigation to be conducted in accordance with law and pass such order or orders…”
2. Heard Ms.Ayesha Azma, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that the Police have not registered the crime since the matter is of Civil in Nature. 4. Recording the same, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedy before appropriate forum according to law. No costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
