The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) in connection with Crime No.0092/2025, registered at Police Station – Deputy Commissioner Excise Divisional Flying Scott Sarguja, District Sarguja (C.G.) for the offence punishable under Section 22(C) of GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.06 19:27:46 +0530
2 NDPS Act. 2. The prosecution story in brief, is that on 16.08.2025, officers of PS Excise Circle Sarguja, District Sarguja CG has recovered 94 Nos. of Rexogesic Buprenorphine Injection (Unit-Quantity 02 ML; Total- Quantity 188 ML) and 81 Nos. of Avil Pheniramine Injection (Unit- Quantity 10 ML; Total-Quantity 810 ML) from the illegal possession of the Applicant. On the same day, the Applicant was arrested in connection with the commission of an offence punishable under Section 22(C) of the NDPS Act. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the charge-sheet has been filed in this case. It is further submitted that no any contraband article seized from the possession of the applicant, the applicant is in jail since 16/08/2025 and the conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that 94 Nos. of Rexogesic Buprenorphine Injection (Unit-Quantity 02 ML; Total-Quantity 188 ML) and 81 Nos. of Avil Pheniramine Injection (Unit-Quantity 10 ML; Total-Quantity 810 ML) has been seized from the possession of the applicant, which is above the commercial quantity. It is further submitted that the charge- sheet has been filed in this case. Hence, this bail application is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material

Taking into consideration the fact that the quantity of contraband article seized from the possession of the applicant i.e. 94 Nos. of Rexogesic Buprenorphine Injection (Unit-Quantity 02 ML; Total-Quantity 188 ML) and 81 Nos. of Avil Pheniramine Injection (Unit-Quantity 10 ML; Total- Quantity 810 ML) is above the commercial quantity and further the applicant has failed to give explanation for the same and it cannot be a case of false implication, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Preetam Kumar Ravi involved in Crime No.0092/2025, registered at Police Station – Deputy Commissioner Excise Divisional Flying Scott Sarguja, District Sarguja (C.G.) for the offence punishable under Section 22(C) of NDPS Act, is rejected. 8. The Office is directed to send a certified copy of this order to the trial Court for necessary information and compliance forthwith. Sd/-
