Both these applications have been filed under Section 482 of the Code of Criminal Procedure, 1973 for quashment of the proceedings in Regular Criminal Case No.125/2023 pending before learned Judicial Magistrate First Class, Sindkheda, Tq. Sindkheda, Dist. Dhule arising out of First Information Report vide Crime No.94/2023 dated 10.04.2023 registered with Police Station, Nardana, Tq. Sindkheda, Dist. Dhule, for the offence 5 68_Cri.Appln_2461_2024 punishable under Sections 498-A, 494, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860. 2 All the accused persons, who have been named in First Information Report and charge sheet, are the applicants before us. It is not in dispute that respondent No.2 got married to applicant No.1 on 29.07.2018. 3 During the pendency of applications, a petition bearing No.140/2024 was filed by applicant No.1 – husband and respondent No.2 – wife before learned Judge, Family Court, Dhule for divorce by mutual consent under Section 13-B of the Hindu Marriage Act, 1955. The said terms of settlement have been got read and recorded by a competent Court and those terms can be considered here in the present matter also. The compromise term No.6 in the said petition reads as under - “6½ vtZnkj ua-1 o vtZnkj ua-2 ;kauh nk[ky dsysY;k dslsl fouk’krZ dk<qu ?ks.kkj vkgsr o R;klkBh ykx.kkjs loksZrksijh lgdk;Z ,desdkl djrhy vls Bjys vkgs-” Accordingly, the petition was allowed on 15.11.2024. 4 Herein also applicants and respondent No.2 have filed affidavit / pursis and reiterated the said terms once again. As per the said terms of settlement, respondent No.2 and applicant No.1 have decided to bury the 6 68_Cri.Appln_2461_2024 differences and respondent No.2 - informant has given no objection for quashment of the proceedings. Since the dispute that arose was matrimonial dispute and now the parties i.e. applicant No.1 and respondent No.2 have decided to part, there is no hurdle in allowing the applications. Hence, following order. ORDER i) Both Criminal Applications stand allowed. ii) The proceedings in Regular Criminal Case No.125/2023 pending before learned Judicial Magistrate First Class, Sindkheda, Tq. Sindkheda, Dist. Dhule arising out of First Information Report vide Crime No.94/2023 dated 10.04.2023 registered with Police Station, Nardana, Tq. Sindkheda, Dist.
