GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents particularly 5th respondent in not conducting proper investigation and not filling Charge Sheet in Crime/F.I.R. No 09 of 2025, dt. 01.02.2025 under Section 318(4) BNS and 67 I.T.Act 2000-2008 on the file of 5th respondent as against 2 cyber fraudsters and his accomplice and not subjecting the offenders to trace the fraudsters and recovery, as illegal, irregular and amounts to non-discharge of legal obligation conferred on the respondents under the provisions of Code of BNSS Act 2023 and offends Articles 14 and 21 of Constitution of India and consequently direct the 5th respondent to investigate into the said crime and file Charge Sheet against the online fraudsters and his accomplice and prosecute the accused persons for appropriate offences under penal provisions of law by subjecting the offenders to the process of arrest and judicial remand” 2. Heard Sri Kishore Kumar Katari, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that a direction may be given to the respondent/police to conclude the investigation in Crime No.09 of 2025 and file a final report. 4. Learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 5. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed to conclude the investigation in the above crime and file a report in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.
