and 23 of Akkarampalli revenue Village, Tirupati Urban Mandal, Tirupati District and trying to disposes us in the subject property without following the procedure as illegal, arbitrary, unconstitutional, and without jurisdiction, and consequently direct the 2nd respondent to consider the representation submitted by the petitioners dated 10.11.2025 against the unlawful interference of 3rd Respondent, and pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd Respondent not to interfere with the peaceful possession and enjoyment of the Petitioners in the survey No.53, 54 vide Plot Numbers 3,4,9 and 23 of Akkarampalli revenue Village, Tirupati Urban Mandal, Tirupati District pending disposal of the above writ petition and pass such Counsel for the Petitioner(S):

ORDER: The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:
“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the highhanded action of the respondents more particularly Respondent No. 3 in interfering with the peaceful possession and enjoyment of petitioners in the survey NO.53,54 vide Plot Numbers 3,4,9 and 23 of Akkarampalli revenue Village, Tirupati Urban Mandal, Tirupati District and trying to disposes us in the subject property without following the procedure as illegal, arbitrary, unconstitutional, and without jurisdiction, and consequently direct the 2nd respondent to consider the representation submitted by the petitioners dated 10.11.2025 against the unlawful interference of 3rd Respondent, and pass such….”
2. Heard M/s. Eluru Sesha Mahesh Babu, learned counsel for the petitioners and learned Assistant Government Pleader appearing for respondents.

Learned counsel for the petitioners submitted that the house site pattas were granted in favour of the petitioners way back in the year 1995 and the petitioners are in continuous possession, now the respondents, without considering the said pattas, are trying to interfere with the possession of the petitioners over the schedule property.
4. During the course of hearing, learned Assistant Government Pleader for Revenue requested time for getting instructions in this matter.

5. Considering the submissions, the respondents are directed not to interfere with the peaceful possession and enjoyment of the petitioners over the subject property, without following due process of law.
6. With the above observation, the Writ Petition is disposed of. No costs.
As a sequel thereto, interlocutory applications pending, if any, in the writ petition, shall also stand closed.
