G.P. for Finance Planning The Court made the following: 2 W.P.No.30737 of 2024 ORDER: This writ petition is filed under Article 226 of Constitution of India seeking following relief: “...to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents in not releasing the un-paid balance subsidy amount of Rs.27,05,000/- towards supply of Tafe Tractors under various Government Schemes Rythu Radham (RR), SMAM (mini-tractors) and CMC group deliveries for the year 2018-19 through the petitioners firm, as illegal, arbitrary, unjust, unreasonable and unconstitutional being violative of Articles 14 and 21 of Constitution of India and consequently direct the respondents Nos.1 to 3 to pay amounts due to petitioner in respect of supply of said tractors forthwith along with accrued interest at 18 percent pa and to pass...” 2. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled to the claim amount, no payment is made. The petitioner contends that such non- payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 3. On the other hand, learned Government Pleader for Agriculture, while admitting about the agreement amount, placed on record instructions received from the respondent No.3 vide Letter No.Court Case/3737/2024, dated 01.12.2025. He further submitted that gross amount of Rs.26,55,720/- was pending before the respondents for need of budget release from the government. 3 W.P.No.30737 of 2024 4. In view of the submissions of the learned counsel for the petitioner and the learned Government Pleader for Agriculture, this Writ Petition is partly allowed with a direction to the respondents to release the amount of Rs.26,55,720/- (twenty six lakh fifty five thousand seven twenty Rupees only) to the petitioner along with the interest as per the entitlement, within a period of two (02) months from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed. ___________________ B. S.
