With the consent of the parties, heard finally. 2. The petitioner has filed this writ petition on the following reliefs: “10.1. That, the Hon’ble Court may kindly be pleased to issue necessary direction to the respondent authority to consider his application/Representation dated 2 23.04.2025 and correct the father’s name as “Venkateswar Ralabandi” and his mother’s name is “Prabhawati Ralabandi” in 10th and 12th marksheet. 10.2 That, this Hon’ble Court may kindly be pleased to issue direction to the respondent authority that after the correction, provide the correct 10th and 12th Marksheet to the petitioner. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate looking to the facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that the petitioner is not challenging any particular order, but seeking direction by this Hon’ble Court against the inaction on the part of the respondents, whereby the respondent authority is not taking any decision in the case of the petitioner for correction in her father’s and mother’s name in 10th and 12th marksheet. Petitioner is residing in her uncle’s house namely Sanjay Ralabandi from her childhood, so the uncle of the petitioner wrote his name in all the documents of the petitioner, bu the petitioner wants to correct her father and mother name in her 10th and 12th CBSE Marksheet. The petitioner completed all the formalities prescribed in para 170-171 of Jigya Yadav (minor) Vs. CBSE and Others in Civil Appeal No. 3 3572/2019 which was delivered by the Hon’ble Supreme Court. Counsel for the petitioner has filed the copy of the e-mail sent by CBSE to Principal of DAV School, Manjhiguda, Bijapur C.G. through a covering memo which reads as under: “With ref to your letter regarding correction in r/o above mentioned candidate. The school is advised to submit the documents as per paragraph 171(a) of Jigya Yadav Vs CBSE case. Need court order for full name change.” 4. Learned counsel for respondent draws attention of this Court towards Annexure P/4 wherein at S.No. 18 of Mandatory Proforma to be sent by the School alongwith School Records it is mentioned as “Whether Parents were made aware about the important of particulars at the time of registration and filing LOC. Give your remarks- Yes, But the girl was adopted from the very childhood stage.” He further contended that since the girl was adopted from the very childhood stage, a declaration decree will be required from the competent civil Court. The petitioner needs to file a civil suit for declaration. Therefore, the present petition deserves to be dismissed as not maintainable. 5. Heard learned counsel for the respective parties and perused the record with utmost circumspection. 6. Considering the facts and circumstances of the case, nature of grievance raised in this writ petition, submissions of the counsels for the respective parties, the petitioner may file civil suit before 4 the competent civil court for declaration decree, if so desire. 7. With the aforesaid observation/direction, the petition stands disposed of. 8. It is made clear that this Court has not expressed any opinion with regard to the merits of the case.
