COMMON ORDER:
The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) been filed by the Petitioner, seeking quashment of the proceedings against him in Crime No.99 of 2025 on the file of Snathanutalapadu Town Police Station, Prakasam District for the offences under Sections 338, 340(2) and 61(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2
2. I.A.Nos.2 and 3 of 2025 are filed by Respondent No.3/De facto complainant seeking permission to compound the offences and compromise the matter with the Petitioners. 3. Petitioner / Accused and Respondent No.3 appeared before this Court and were identified by their respective learned counsel. Copies of their Aadhar cards attested by their respective counsel are filed for proper identification. 4. Learned Assistant Public Prosecutor is in attendance. 5. Both parties would submit that they came to an amicable settlement and filed a joint memo to that effect for withdrawal of the present case pending between them. Respondent No.3 by way of an affidavit would submit that, at the intervention of well-wishers and family elders of both sides, the matter was settled between the parties out of the Court and in view of the same, he intends to compound the offences alleged against the Petitioner and compromise the matter with them, in the present case and prays for quashment of the case. 6. Considering the submissions, in terms of the compromise arrived at between the parties, and in the interest of justice, I.A.Nos.2 and 3 of 2025 are allowed.
Consequently, the Criminal Petition is allowed and the case against the Petitioner / Accused in Crime No.99 of 2025 on the file of Snathanutalapadu Town Police Station, Prakasam District, is hereby quashed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. ________________________________________
