This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents police in not registering the FIR basing on the complaint of the petitioner dated 28.07.2020, 02.08.2020 and 09.04.2021 is illegal, arbitrary and against the principles natural justice and also violation of Article 14, 19, 21 and 300-A of Constitution of India as per the Apex Court Judgment Lalita Kumari Vs.
Government of Uttar Pradesh and consequently direct the respondents police to entertain the complaint and register the FIR against the culprits and pass.”
2. Heard Sri P.V.Krishnamachary, learned Counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that police are not taking any action against the complaints dated 28.07.2020, 02.08.2020 and 09.04.2021 given by the petitioner. 4. Learned Assistant Government Pleader on written instructions would submit that earlier Cr.No.121 of 2019 for the offences under Section 107 Cr.P.C., on the file of Yetapaka Police Station has been registered with regard to the same subject land and no further orders are required to be passed in this matter. 5. Recording the submission of the learned Assistant Government Pleader, this writ petition is disposed of. There shall be no order as to costs. 4
