2 deposited by the petitioner under different head in the account of respondent no.1, though the said amount was meant for Assistant Commissioner Excise Durg. 2. Learned counsel for the petitioner submitted that by mistake an amount of Rs. 3,74,170/- has been deposited in the account of respondent no. 1, i.e. Assistant Commissioner Excise Department Regional Flying Squad Durg, though the said amount was to be deposited in the account of Assistant Commissioner Excise Durg. The petitioner submitted a representation to the Deputy Commissioner flying Squad Durg, Division Durg for refund of the said amount which has been deposited in the account of the Assistant Commissioner Excise Department Regional Flying Squad Durg by mistake, however, the respondent has not taken any steps for refund of the said amount. 3. Learned counsel for the respondent/State would submit that as the representation has been submitted to the Deputy Commissioner the petitioner may approach the respondent no. 1 with a fresh representation requesting the refund, if any, the same shall be considered within a stipulated period. 4. I have heard both the counsels for the parties. 5. On perusal of the representation (Annexure P/6), the petitioner has pleaded that the amount of Rs. Rs. 3,74,170/- has wrongly been deposited in the account of respondent no. 1 i.e. Assistant Commissioner Excise Department Regional Flying Squad Durg. On the event of filing the representation, respondent no. 1 is directed to consider the same and take necessary steps and pass order
3 regarding the alleged claim made by the petitioner by examining the fact narrated by the petitioner within a period of 25 days from filing of such representation. 6.
With the aforesaid direction, the writ petition is disposed of. Sd/-
