This contempt petition has been filed alleging wilful disobedience of the order dated 02.07.2024 passed in WPSS No. 1098 of 2024. By the said order, the writ petition was disposed of with a direction to Executive Officer, Nagar Panchayat, Sultanpur, District Udham Singh Nagar to take decision on petitioner’s representation dated 16.03.2024. In his representation, petitioner had staked claim for provisional pension, as there is a criminal trial pending against him. 4. Dr. K.H. Gupta, learned counsel for Nagar Panchayat/opposite party has produced in Court the letter dated 29.08.2024 issued by Executive Officer, which is addressed to petitioner. Perusal of the said letter reveals that papers for grant of provisional pension have been prepared and sent to the State Government. 5. Learned counsel for the opposite party has also drawn attention of this Court to communications dated 10.02.2025 & 09.05.2025, which were issued by Executive Officer, Nagar Panchayat Sultanpur to District Magistrate, Udham Singh Nagar and Director, Audit Directorate, Dehradun for 2025:UHC:3962 release of provisional pension to the petitioner. The communications, supplied by learned counsel for the opposite party, are taken on record. 6. Since the Executive Officer has done the needful in terms of the order passed by Writ Court, therefore, this Court does not find any reason to initiate contempt proceedings against the opposite party. 7. The contempt petition is accordingly disposed of by directing the State Government to examine the matter and take decision, as per law, within six weeks from today.
