GP FOR FINANCE PLANNING The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondents herein in withholding the payments of total amount of Rs.7,62,44,452/- (Seven Crores Sixty two Lakhs Forty four Thousand Four hundred and fifty two only) even after admitting the bills payable to the Petitioner in relation to the work i.e. for installation of CCTV Systems in 34 Sub-Jails of Andhra Pradesh to comply with the orders of the Hon’ble Supreme Court and High Court of Andhra Pradesh under vide Agreement dt. 28.07.2023 is 2 questioned as the same is illegal and arbitrary apart from violation of Articles 14, 19, 21, 300-A of the Constitution of India and consequently direct the Respondents to make the payments of an amount of Rs.7,62,44,452/- forthwith along with an interest @ 24 percent per annum.” 2. Learned Government Pleader for Finance Planning placed on record the written information received from the Principal Secretary to the Government showing the status of the bill as “Waiting for fund clearance” and seeking ten weeks time. 3. Ms.A.Swarupa Reddy, learned counsel for the Petitioner would submit that they have completed the work by 28.07.2023. It is further submitted that, huge amount is pending with the Government for clearance and let there be a direction to clear the amount as expeditiously as possible. 4. Considering the submissions made, the Writ Petition is disposed of directing the Respondents to clear the amount under CFMS Bill ID 2025- 1406247, within a period of one week from the date of receipt of copy of this order. Respondents are further directed to clear the amount under CFMS Bill ID 2025 – 1412853, within two weeks therefrom. Respondents are further directed to clear the amount under CFMS Bill ID 2025 – 1413171, within three weeks therefrom. Respondents are further directed to clear the amount under CFMS Bill ID 2025 – 1386313, within four weeks therefrom. There shall be no order as to costs.
