Serial No. 10 Regular List HIGH COURT OF MEGHALAYA AT SHILLONG WP(C) No. 60 of 2025 Date of Decision: 21.05.2025 Shri Desmingroy Pariong …. Petitioner(s) Versus 1. Khasi Hills Autonomous District Council, Represented by its Secretary, Shillong East Khasi Hills District 2. The Executive Committee, Khasi Hills Autonomous District Council, Shillong. 3. The Sirdar of Nonglang Sirdarship Ri Nongtrai, Langdongdai, West Khasi Hills District, Meghalaya 4. Shri Bistarland Pariong S/o (L) Sikson K. Dewsaw, R/o Tynhiang Village, Nonglang Sirdarship, West Khasi Hills District, Meghalaya … Respondent(s) 2025:MLHC:432 ________________________________________________________ Coram: Hon’ble Mr. Justice H. S. Thangkhiew, Judge Appearance: For the Petitioner(s) : Mr. M.F. Qureshi, Adv. with Mr. L Koch, Adv. For the Respondent(s) : Mr. T.T. Diengdoh, Sr. Adv. with Mr. R. Kharsyad, Adv. (For R 1&2) Mr. D. Dkhar, Adv. (For R 3) Mr. K.V. Kharlyngdoh, Adv. (For R 4) i) Whether approved for reporting in Yes/No Law journals etc: ii) Whether approved for publication Yes/No in press: (ORAL) 1. By this second round of litigation the petitioner assails the impugned order dated 17.10.2024, whereby the order passed by the respondent No. 3, was upheld and not interfered with by the respondent No. 2 in the matter of the dispute to the post of Sirdar of Tynhiang Village, which the petitioner claims that he is still holding. 2. It is seen that in the earlier writ petition namely WP(C) No. 392 of 2023 by the order dated 13.12.2023, this Court while disposing of the writ petition had directed that the Political Appeal relating to the instant matter be taken up by the respondent No. 2, for fresh 2025:MLHC:432 consideration. However, it seems that on a fresh consideration the matter was taken up and disposed of by a single Executive Member. 3. As in the other cases, Mr. T.T. Diengdoh, learned Senior counsel has submitted that the same is without jurisdiction being not in terms of Rule-31 of The Assam and Meghalaya Autonomous Districts (Constitution of District Councils) Rules, 1951. 4. Accordingly, on the submission of the parties, the impugned order is set aside and the Political Appeal is remanded back for fresh consideration by the respondent No. 2. 5. As the matter is pending for some time, it is expected that expeditious hearing be granted. 6. The matter stands disposed, on the terms ordered above. JUDGE Meghalaya 21.05.2025 “V. Lyndem-PS” 2025:MLHC:432 Digitally signed by VALENTINO LYNDEM Date: 2025.05.21 06:03:11 IST
