JUSTICE RAJNESH OSWAL, JUDGE ORDER (ORAL) ARUN PALLI-CJ Learned counsel for the appellant submits that ex facie the learned Writ Court had dismissed the petition, for, it lacked material particulars/ necessary pleadings, as also the material documents that ought to have been appended with the petition. Thus, it is urged that the learned Single Judge could always permit the appellant to withdraw the petition with a liberty to file afresh with better particulars. For, if the order that is being assailed is affirmed, the appellant, for all times, shall stand deprived to prove her claim. Mr. Ravinder Gupta, learned AAG and Ms. Sagira Jaffer, learned Assisting Counsel to Ms. Monika Kohli, learned Sr.AAG, present on behalf of the respondents submit that in the given circumstances, let the order under challenge be set aside and the appellant be permitted to withdraw the petition with liberty prayed for. In the wake of the above and in terms of the statement made by learned counsel for the parties, the impugned order dated November 24, 2025 is Sr. No. 05 LPA No. 308/2025 Page 2 of 2 set aside. The appellant is permitted to withdraw the writ petition itself with liberty to file afresh, if so advised, with better particulars and all necessary documents. Disposed of in the above terms.
