Order 21/02/2025
1. Petitioner has preferred this Criminal Writ Petition (Parole) with a limited prayer for waiving the condition of furnishing two attested sureties imposed by the State level Parole
[2025:RJ-JP:7877-DB] (2 of 3) [CRLW-147/2025] Committee of the Department of Home (Group-12) Government of Rajasthan vide order dated 15.01.2025, on the ground that financial condition of the petitioner is very weak.
2. Report was sought from the learned State Counsel with regard to financial status of the petitioner. A report has been received from Sub Inspector, PS Jahangirabad, District Janpad, Bulandshahr (Raj.), from perusal of which, it is revealed that financial condition of the petitioner is very weak. He is not in a position to furnish sureties imposed by the Authority and thus, he is unable to avail the benefit of parole.
3. It is also contended by counsel for the petitioner that he was earlier granted benefit of regular parole and he surrendered before the Jail Authorities within stipulated period. He has also contended that he was earlier released on fourth regular parole by the Parole Committee subject to furnishing personal bond with two sureties of Rs. 50,000/- each but condition to furnish sureties was waived and he was directed to be released on personal bond only by this court, vide order dated 18.12.2023 (Annex. 2).
4. We have perused the order dated 15.01.2025 as well as report with regard to financial status of the petitioner submitted by the Sub Inspector PS Jahangirabad, District Janpad, Bulandshahr (Raj.).
5. From perusal of the order dated 15.01.2025, it is evident that petitioner was granted permanent parole on furnishing
[2025:RJ-JP:7877-DB] (3 of 3) [CRLW-147/2025] personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each. Petitioner was unable to produce the sureties imposed by the Authority and was thus unable to avail the benefit of parole.
6. Since, parole application filed by the petitioner has been allowed and the only prayer of petitioner is to waive the condition imposed by the Authority with regard to furnishing two sureties and such condition was earlier also waived by this court at the time of releasing him on fourth regular parole, this Court deems it proper to dispose of the present Criminal Writ Petition (Parole) and modify the order dated 15.01.2025, qua the petitioner.
7. Consequently, the present Criminal Writ Petition (Parole) is
disposed of and the order dated 15.01.2025 passed by the State level Parole Committee of the Department of Home (Group-12) Government of Rajasthan is modified to the extent that the petitioner shall be released on permanent parole on furnishing of personal bond of Rs.1,00,000/- only. The condition of furnishing of two attested sureties of Rs.50,000/- each is waived.
