DATED : 03.07.2025 The respondent No.2- Sub Divisional Officer had issued a show cause notice under Section 56 (1)(B) of the Maharashtra Police Act, 1951, to the petitioner, on perusal of the externing the petitioner under various crimes registered against him. 2. The petitioner in response to the above said show cause notice, had visited the relevant police authorities and has also given detailed reply to the said show cause notice so issued to him. 3. It is contended that, by ignoring the factual aspects, the petitioner is externed for a period of one year, against which the petitioner has preferred an appeal, which is pending before the Divisional Commissioner, Amravati. 4. By this Writ Petition, the petitioner is seeking stay to the order passed by the Sub Divisional Police Officer externing the present petitioner on 13.06.2025. 5.
Heard learned Counsel for the petitioner as well as learned APP for the State. As appeal is already pending
2 935 wp 519-2025 before the Divisional Commissioner, Amravati, it would be appropriate to direct the Divisional Commissioner, Amravati, to disposed of the appeal by 12.08.2025. 6. In the meantime, there would be stay to the execution of the order passed by the Sub Divisional Officer Pusad, externing the present petitioner. 7. The petitioner shall co-operate with the Divisional Commissioner, Amravati, to dispose of the appeal without seeking any adjournments. 8. The Writ Petition is disposed of. (URMILA JOSHI-PHALKE, J.)
