ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1.
JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer: a. “A writ in the nature of mandamus direct the 3rd respondent to consider the claim of the petitioner in the light of the recommendation made by the 7th respondent dated 21.12.2020 vide ANNXURE J. b. A writ in the nature of mandamus directs the respondent corporation to pay the full salary from 31-05-2015 to 31-05-2020 for a period of 5 years with consequential benefits to the petitioner. c. To pass any such other order as deems fit under facts and circumstances of the case including the award of costs in the interest of Justice and equity.”
2. The petitioner, now 65 years old, has approached this Court seeking correction of his date of birth, which was recorded at the time of his entry into service in the year 1975. He was appointed as a Mechanic Grade-II in 1975, at which point his date of birth was entered as 01.06.1955. He retired upon attaining the age of superannuation on 31.05.2015. 3. He now claims to have realised that he was “born later,” wishes to “grow younger,” and seeks alteration of his date of birth so that he may return to service. However, he chose not

to initiate any proceedings for correction of his date of birth during his entire service. 4. After retirement, such a request is wholly impermissible. The law is well-settled that even at the fag end of service an employee cannot seek alteration of his date of birth, much less after retirement as is sought. 5. The petition, being devoid of merit, stands rejected. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE
