SAI GANGADHAR CHAMARTY The Court made the following: 3 ORDER: Petitioner/defendant in I.A.No.351 of 2025 in O.S.No.150 of 2012 filed the above revision against the order dated 25.4.2025 in I.A.No.351 of 2025 in O.S.No.150 of 2012 on the file of the learned Principal Civil Judge (Senior Division), Kovvur. 2. Learned counsel for the revision petitioner submitted that the petitioner filed an application under Order XVI Rule 1(2) read with 151 CPC for summoning the Revenue Divisional Officer, Jangareddigudem and also to produce certain documents for cross-examination vide I.A.No.351/2025 in O.S.No.150/2012. The said application was dismissed on 25.4.2025. Aggrieved by the same, the present Revision was filed. 3. The fact remains that the application was filed by the 1st defendant after completion of the evidence and at the stage of arguments. Learned counsel for the respondents/plaintiffs has also brought to the notice of the Court that in the counter filed by the respondents to the said application categorically stated that while examining the Tahsildar as P.W.3 has produced the documents before the Court and certain relevant documents were marked on plaintiffs side as Ex.A15 and A16. 4. In the said circumstances, as already the concerned authority was cross-examined and the documents were also placed in the suit, there is no necessity to allow the application. 4 5. Hence, this Court is not inclined to interfere with the orders passed by the trial Court in I.A.No.351 of 2025 in O.S.No.150 of 2012 dated 25.4.2025. But at the same time, the costs imposed on the petitioner/defendant in the impugned order are set aside. 6. Accordingly, the Civil Revision Petition is dismissed. No costs.
