Midde Sreenivasulu, Mahalakshmi Sreenivasulu S/o M.Subbaiah, aged about 55 years R/o 18/206-E2-A1, Venugopal Nagar, AnanthapuramTown ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent No. 3 and 4 in not registering the crime against the 5th Respondent and the action of 2nd Respondent in not initiating departmental action against the Respondent Nos. 3 and 4 for interfering in civil disputes and for aiding the 5th Respondent in his illegal acts, as illegal, arbitrary, without jurisdiction and violative of Art 14 of Constitution of India and to consequently direct the Respondent No. 3 and 4 to forthwith register the crime against the 5th respondent pursuant to the complaint made by petitioners on 4.9.2023 and also direct the 2nd Respondent to forthwith initiate departmental action against the 3rd and 4th Respondents for interfering in civil disputes and for aiding and supporting the 5th Respondent in his illegal acts and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to issue interim directions to the Respondent No. 3 and 4 to forthwith register the crime against the 5th respondent pursuant to the complaint made by petitioners on 4.9.2023 and also direct the 2nd Respondent to forthwith initiate departmental action against the 3rd and 4th Respondents for interfering in civil disputes and for aiding and supporting the 5th Respondent in his illegal acts, pending disposal of W P No. of 2023 and pass Counsel for the Petitioners: N RANGA REDDY Counsel for the Respondents: GP FOR HOME Counsel for the Respondents:O M R LAW FIRM THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 26791 OF 2023 The Court made the following order: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent No.3 and 4 in not registering the crime against the 5th Respondent and the action of 2nd Respondent in not initiating departmental action against the Respondent Nos. 3 and 4 for interfering in civil disputes and for aiding the 5th Respondent in his illegal acts, as illegal, arbitrary, without jurisdiction and violative of Art 14 of Constitution of India and to consequently direct the Respondent No. 3 and 4 to forthwith register the crime against the 5th respondent pursuant to the complaint made by petitioners on 4.9.2023 and also direct the 2nd Respondent to forthwith initiate departmental action against the 3rd and 4th Respondents for interfering in civil disputes and for aiding and supporting the 5th Respondent in his illegal acts and pass such other or further orders…” 2. Heard learned counsel for the petitioners and Mr. V Farooq, learned Assistant Government Pleader for Home representing the respondents. 3. When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents, on written instructions, brought to the notice of this Court that basing on the complaint of the petitioners a crime was registered in Cr.No.118/2018 under Sections 447, 427, 506 r/w. 34 IPC on the file of SHO Garladinne Police Station and took up investigation. After completion of investigation the I.O filed charge sheet and the same is pending vide C.C No.28/2020 on the file of Special JFCM, Ananthapuramu. 4. Recording the above said submissions, this Writ Petition is disposed of. There shall be no order as to costs.
