Khan, learned Senior counsel through V.C., assisted by Mr. Vinay Bhatt, learned counsel for the petitioner. 2. Mr. Mukesh Singh Rawat, learned counsel, holding brief of Mr. S.S. Chauhan, learned counsel for the respondents. 3. The instant contempt petition has been preferred for flouting the order passed by the Division Bench of this Court dated 26.11.2024 passed in WPMB No.538 of 2024, wherein the parties were directed to maintain status quo. 4. The subject matter of the writ petition was relating to a tender flouted by the respondent- department in which the present petitioner M/s Airson Construction Company was the party respondent whose financial bid was opened on 25.10.2024 and he was found to be a lowest bidder L-1. 5. Mr. T.A. Khan, learned Senior counsel submits that the order of maintaining status quo has been flouted by the officials-respondent since after the verification of the experience certificate of the petitioner of WPMB No.538 of 2024, he was declared to be eligible and the entire process of the tender relates to back the process of verifying the technical bid of all the bidders. 6. Mr. Kapil Singh, the Chief General Manager, join the proceedings through V.C and apprise to this Court that the order dated 26.11.2024 has not been violated and the status quo has been maintained and till date neither any work has been awarded nor any further steps have been taken and only after getting a verification report, the petitioner of WPMB No.538 of 2024 was declared to be eligible. 7. Mr. Kapil Singh, the Chief General Manager, undertakes that he will maintain the order passed by this Court dated 26.11.2024 by maintaining status quo and the verification report and the 2025:UHC:2776 decision taken thereon with regard to declaring the petitioner of WPMB No.538 of 2024 to be eligible shall bring to the notice of this Court in pending WPMB No.538 of 2024. 8. Since now the Chief General, Kapil Singh, gives an undertaking that he will apprise about the verification report in pending WPMB No.538 of 2024 and he also undertakes that he will not proceed further until and unless the matter of WPMB No.538 of 2024 be decided. 9. In such an eventuality, there is no purpose to keep this contempt petition pending, accordingly, the present contempt petition is disposed of finally.
