Neutral Citation No. - 2025:AHC:72076 Court No. - 4 Case :- WRIT - A No. - 6073 of 2025 Petitioner :- Narendra Singh Yadav Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Alka Srivastava Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Ms. Alka Srivastava, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for payment of salary for the period from month January 2023 to June 2023 along with interest as he remained under suspension during the said period. It is contended on behalf of the petitioner that the petitioner has earlier challenged the suspension order vide Writ - A No. 531 of 2023 in which the suspension order was stayed. In view of the above, the petitioner continues to remain in employment but ultimately disciplinary proceedings have culminated into an order of reinstatement of the petitioner in service closing the entire disciplinary proceedings. Thus, according to the petitioner the said earlier writ petition has now become infructuous and now petitioner's claim for payment of salary deserves to be allowed. It is contended that the petitioner has approached the competent authority by making representation on 16.09.2023 to the Special Secretary, Government of U.P. but till date no decision has been taken. Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 1 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 1 shall consider the grievance of the petitioner raised in his representation and decide the same within a
period of two months from the date of receipt of certified copy of this order. Needless to add the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
