1. This is an ofÏce reference.
2. This Court, vide order dated 13.12.2023, passed in MCRC No. 7876 of 2023, while allowing the bail to the applicant, namely, Varsha Vankhede, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal impediment. 3. The learned Chief Judicial Magistrate, Ambikapur, District-Surguja, (C.G.) vide his request letter dated 07.01.2025 has requested for grant of six months time for concluding the trial.
4. It transpires from perusal of the PUD, that the case has been scheduled for continuous evidence recording at short intervals following the charge-sheet filing. Despite this, eight crucial witnesses, including important witnesses, seizure witnesses and investigating police ofÏcers are remain to be examined. Regular processes are being issued, but they're being returned unserved due to law and order duties. To address this, the prosecution has been directed to ensure their witnesses are present at the next hearing dates. further, the accused's statements need to be recorded and final arguments must be heard. In this situation, it seems unlikely that the case can be concluded within the stipulated timeframe. Hence, he prays for grant of further six months time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of six months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
