The petitioner seeks bail in connection with Patahi P.S. Case No. 195 of 2024 registered for the offence punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita. 3. As per the prosecution case, the petitioner is accused of killing the deceased. 4. It has been submitted by learned counsel for the petitioner that the petitioner is only suspected of killing the deceased and there is no material against him. 5. The petitioner is in custody since 20.08.2024. 6. Learned counsel for the informant submits that at the instance of the petitioner, the murdered weapon (Daab) was Patna High Court CR. MISC. No.74239 of 2025(5) dt.30-03-2026 2/2 recovered. 7. Considering the aforesaid facts, I am not inclined to grant bail to the petitioner. 8. Accordingly, the application stands dismissed. 9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
