No.10929 of 2025 ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 16.01.2023 for the offences punishable under Sections 8(c) r/w.20(b)(ii) (c), 25, 29(1) of NDPS Act in Crime No. 19 of 2023 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 1200kgs of ganja. Hence, the case.. 3. The learned counsel for the petitioner submits that the respondent police has registered a false case against the petitioner and he is not involved in any such activities as alleged by the respondent police. He would further submit that co-accused in this case was granted bail by this Court and the investigation in this case is almost completed. He would further submit that the petitioner has been arrested and remanded to judicial custody on 16.01.2023. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner along with other accused were found in illegal possession of 1200kgs of ganja. Hence, he opposed to grant bail to the petitioner. 5. This Court heard both sides and perused the materials available on record. 6. Considering the rival submissions on either side and that the contraband involved in this case is commercial quantity and further the petitioner is none other than owner of the lorry in which the contraband was transported and further petitioner has not satisfied the twin condition as per Section 37 of the NDPS Act hence this Court is not inclined to grant bail to the petitioner. 7.
